Judge Halts Indiana Town’s Cruel Attempt to Fine Residents Out of their Properties

A judge in Indiana has stopped a city’s nasty plot to make people sell their homes to a redeveloper or else face thousands of dollars of rapidly accumulating fines.

In Charlestown, Indiana, a community north of Louisville with a population of less than 8,000, the mayor and other city leaders have been trying to transfer ownership of private plots of land in the low-income neighborhood of Pleasant Ridge to a developer. This developer would then raze all the properties and build an entirely new neighborhood.

Charlestown did not take advantage of Kelo v. City of New London, the Supreme Court decision that allows the government to transfer property to a private developer via eminent domain. That would have required the city to pay the property’s current owners.

Instead, the city targeted Pleasant Ridge with ruthless code enforcement. Property owners were cited and fined hundreds of dollars for every individual violation. Unlike the usual practice in code enforcement, the owners were not given any grace period to correct the problems before the fines were levied: They were levied immediately and compounded dailyuntil the problems were fixed. And even when the violations were fixed, the owners had to pay the fines. The only relief offered to them came if they agreed to sell their properties to the developer.

A school district removed a principal Monday after the majority of its graduating students missed over six weeks of school and still graduated.

Antwan Wilson, chancellor of D.C.’s public schools, removed Yetunde Reeves as principal of Ballou Senior High School, reported The Washington Post. Wilson made the decision less than a week following an endorsement of Reeves.

No, the FCC Isn’t ‘Overturning Net Neutrality’

The left is in a veritable state of hysteria as the Federal Communications Commission (FCC) moves to vote on Chairman Pai’s deregulatory “Restoring Internet Freedom” (RIF) order on Dec. 14. It’s gotten so bad that incensed supporters of so-called “net neutrality” have taken to harassing commissioners’ children and even threatening to kill a congressman.

You know, as they do.

It’s a nasty state of affairs, and it’s one unfortunately driven by a lot of false rhetoric and outright fearmongering over how policy is actually changing. Telling people that a policy change will “end the internet as we know it” or “kill the internet” can agitate troubled people into doing crazy things.

In truth, the Obama administration-era “Open Internet Order” (OIO) that the FCC is overturning has little to with “net neutrality” at all. In fact, the OIO would still allow internet service providers (ISPs) to block content—to say nothing of the many non-ISP tech companies that can and do openly suppress access to content.

Furthermore, repealing the OIO does not mean that the principles of “net neutrality” will not be upheld, nor that ISPs will be “unregulated.” Rather, the RIF will rightly transfer oversight of ISPs to other regulatory bodies in an ex post fashion.

Don’t Register Anything

Putting yourself on a registry of people who engage in activities, or own goods, that are even mildly controversial makes you vulnerable to abusive officials.

This is especially true in Blue (i.e. proto-Communist) states.

Like too many jurisdictions, Hawaii requires gun owners to register their firearms. Also like an excess of other control-freaky places, the state requires medical marijuana users to register themselves with the state Department of Health. As it turns out, those who dutifully abide by both requirements find themselves in trouble. Hawaii may allow the use of marijuana for medicinal uses, and even require registration of its users, but the state continues to regard the practice as a violation of federal law. As a result, Honolulu residents who legally complied with requirements that they enter themselves in both registries have received threatening letters signed by officials including Honolulu Police Chief Susan Ballard.

Federal law restricts the possession of firearms by anybody who is an “unlawful user of or addicted to any controlled substance,” and marijuana remains a controlled substance according to the folks in D.C. That’s enough of an excuse for Honolulu police officials to try to disarm locals who’ve done their best to abide by state gun and marijuana laws.

But it’s not just a Hawaii problem. As Jacob Sullum previously noted, “Last year the U.S. Court of Appeals for the 9th Circuit, which includes Hawaii, upheld the ATF’s policy of banning gun sales to people who are known to have medical marijuana cards, even if they do not currently consume cannabis.” So putting your name on a medical marijuana registry anywhere has the potential to make it more difficult to legally buy a firearm.

Primum Non Nocere

Used to be, in the Good Old Days, there was this thing called the Hippocratic Oath.

Although not actually part of the classical Hippocratic Oath, the phrase Primum Non Nocere has traditionally been associated with in conventional understandings of medical ethics.

It means ‘First, to do no harm’. That this is the essence of the ethical standard to which medical practitioners are to be held used to be unquestioned. But these days … not so much.

‘Want me to kill your baby? Want me to kill your grandmother? Hey, so long as I won’t go to jail for it, I’m good.’ appears to be the new medical ethical standard.

The Odds of Impeachment Are Dropping

Now that Michael Flynn has pleaded guilty to lying to the FBI, and agreed to dish on his former boss, some Trump-watchers are suggesting that impeachment may be around the corner. “It’s time to start talking about impeachment,” announced a Saturday column on CNN.com. The Flynn deal, declared former Deputy Assistant Attorney General Harry Litman in Friday’s New York Times, “portends the likelihood of impeachable charges being brought against the president of the United States.”

That may be true. But bringing impeachment charges against Trump, and actually forcing him from office, are two vastly different things. And while the former may be more likely today than it was half a year ago, the latter is actually less likely. Since Robert Mueller became special counsel in May, the chances of the House of Representatives passing articles of impeachment—and the Senate ratifying them—have probably gone down.

Five years ago, in its first report on the subject, IJ ranked Virginia eighth worst. Relatively speaking, the commonwealth is moving backward, not forward.

Of the 102 occupations IJ studied, Virginia licenses 68. That’s up from 46 a few years ago. And the state not only has erected more hurdles, it has raised their height as well.

Since IJ’s last report, average licensing fees have climbed from $153 to $291, and the amount of time an applicant must put in before earning a license has risen from 462 days to 620.

The Downside of Full Pay Transparency

Such pay transparency has many proponents, who argue that it can help motivate employees, close the gender pay gap, and attract new talent by providing a clear picture of how achievement in the company is rewarded.

But it can also have the opposite effect, demoralizing employees and driving valuable talent away, especially when it isn’t clear why some people are paid more than others.

Note that the heart of the problem is not transparency per se but the arbitrary and capricious way some companies pay their employees — a classic ‘shoot the messenger’ scenario. Employees are only ‘demoralized’ when they learn that there is no rhyme or reason to the way the company pays certain people. If that ‘drives valuable talent away’, that’s because said ‘valuable talent’ would otherwise be paid less-than-market rates. Keeping pay rates secret is merely another tool in a company’s kit for cheating employees.

The Boomtown That Shouldn’t Exist

Politico is a rock-solid Voice of the Crust, so the amount of what Scott Adams calls ‘cognitive dissonance’ exhibited in this article should come as no surprise.

Cape Coral may be the best place to gauge the future of the dream—and to see whether Florida has any hope of overcoming its zany developmental, political and environmental history—because Cape Coral is the ultimate microcosm of Florida. It’s literally a peninsula jutting off the peninsula, the least natural, worst-planned, craziest-growing piece of an unnatural, badly planned, crazy-growing state. Man has sculpted it into an almost comically artificial landscape, with a Seven Islands section featuring seven perfectly rectangular islands and an Eight Lakes neighborhood featuring eight perfectly square lakes. And while much of Florida now yo-yos between routine droughts and routine floods, Cape Coral’s fluctuations are particularly wild. This spring, the city faced a water shortage so dire that its fire department feared it couldn’t rely on its hydrants, yet this summer, the city endured a record-breaking flood. And that “50-year rain event” came two weeks before Irma, which was also supposedly a 50-year event.v

Note the distinguishing characteristics of proglodyte dogma: ‘least natural’ (natural good, artificial bad), worst-planned (planned good, unplanned bad), ‘craziest-growing’ (growth is somehow crazy). Statists just can’t comprehend how a people working together without some overall plan by an overarching public authority can somehow come together and make it all work.

As climate change has ushered in a new era of higher seas and deadlier storms, pre-written obituaries keep appearing in magazines like the New Yorker and Rolling Stone, portraying southern Florida as the next Atlantis. As Irma approached, I wrote my own requiem in this magazine, portraying South Florida as an unsustainable paradise. But life does go on.

Note what Scott Adams calls ‘magical thinking’: the ‘new era of higher seas and deadlier storms’ have been ushered in by ‘climate change’, even though there is absolutely no concrete evidence that seas are higher or storms are deadlier or even that ‘climate change’ has anything to do with either. Grad Students Protest GOP’s Tax Hike and Prepare to Fight About Tuition

One of the Left’s tools in its March Through the Institutions that doesn’t get a lot of attention is the push for everybody to go to college. This takes young people out of the job market during a period of life when it’s easiest for them to get used to the requirements of adulthood like Showing Up Every Day, continues them in adolescent bad habits like expecting somebody else to fund their living expenses, and eventually dumps them on the market with a degree that isn’t worth shit so that they spend the rest of their days full of resentment that somebody somewhere cheated them out of the golden lifestyle that they had been promised.

One of the chief warts developed in this process is the reverence for the magic word Funding. Just as adolescents grow accustomed to whining to their parents for money to do whatever it is they want to do, academics and prot0-academics like grad students are engaged in a constant search for Funding, which essentially means finding somebody else to give them money. The tech boom has mitigated this somewhat by providing entrepreneurial opportunities outside of the Magic Funding System, but only for the brightest, i.e. those that would be successful anyway. The mediocre (which is most of them) are still hunting for Funding. This makes them prime candidates for the Left’s sweet song about dependency on government benefits, like government-provided health care.

This is also why the Left is so hostile to vocational training, because vocational training produces people who can actually get a job and support themselves, as well as people who are exposed in the real world and realize that there is no Santa Claus, i.e. Republicans. This is why high schools are always evaluated on how many of their graduates get into college rather than how many of their graduates can actually support themselves. (Lucky for the high schools, most of which these days don’t produce graduates who have been taught skills that will help them actually support themselves.)

ABC News Suspends Brian Ross After Fake Bombshell Story

ABC News has suspended anchor Brian Ross after having to correct what initially seemed to be a bombshell story on President Trump and former national security adviser Michael Flynn that sent markets tumbling.

The veteran newsman has a long history of erroneous reports.

“We deeply regret and apologize for the serious error we made yesterday. The reporting conveyed by Brian Ross during the special report had not been fully vetted through our editorial standards process,” the network said in a statement. “As a result of our continued reporting over the next several hours ultimately we determined the information was wrong and we corrected the mistake on air and online.”

Ross, citing a single anonymous source, falsely reported that Flynn was prepared to testify that Trump ordered him to make contacts with the Russians during the campaign. ABC News later corrected the report, saying the still-unnamed source had “clarified” that Trump’s order took place after the election, during his administration’s transition phase into power.

My, what a surprise. Aren’t you surprised? I’m sure surprised.

Deep Meaning of the Mueller Probe

The reporters covering developments in the ongoing special counsel investigation conducted by Robert Mueller are so excited by the prospect of President Trump’s removal from office impeachment that they can barely keep their tongues from hanging out of their mouths. They demonstrate what it’s all about even if they don’t have a clue what’s going on.

It is a striking fact that the charge to which Michael Flynn pleaded yesterday involves lying about conversations that were not themselves illegal. Flynn was not charged with any substantive criminal offense under the Logan Act or anything else. Rather, he pleaded guilty to lying to the FBI.

Andrew McCarthy has distinguished himself among the observers commenting on the case. An experienced former federal prosecutor himself, he knows what he is talking about. He is familiar with the ground rules that are to govern such matters. He reviews them in his weekly NRO column today as he has before, finding once again that Mueller has undertaken an essentially unlimited criminal investigation in the guise of a counterintelligence probe.

None of the ground rules applicable to a special counsel criminal investigation have been followed. Mueller’s investigation partakes of the wrongs committed by special counsels in past cases — wrongs reflected in the Department of Justice Procedures that are to govern these matters, but that have been thrown out the window.

The chief difference between this situation and all other previous Special Prosecutor situations is that there is no underlying crime. Even if Mueller finds that Trump ‘colluded’ with one or more Russians, that’s not a crime. Flynn, for example, is being prosecuted for lying, which is the same reason as why he was fired. So far, there is nothing to implicate Trump in anything illegal or even unethical. This is all make-believe.

The Last Strawman

If you have been following the news you will have noticed that every day some DemLegHump Media outlet will have a story (or stories) along the lines of ‘This is the last straw!’ or ‘Trump has gone too far this time!’

There appears to be a sentiment among Trump opponents that they are of superior perspecuity to the Great Unwashed and that they can pierce the veil of ignorance to see that Trump is a racist/sexist/whatver-you-goti-st homophobe/tranophobe/whatever-you-got-ophobe, and it’s just a matter of waiting for the Great Unwashed to get it through their thick skulls that Trump Is Actually Hitler and get with the program. Hence they are always on the lookout for that Last Little Bit of Evidence that will prove the tipping point in that (to their minds inevitable) process.

Couple this search (a collateral duty with the search for Heretics and Sinners) with the reflexive urge to see any criticism of women as based on deep-seated sexism (sometimes so deep that the offender himself is not aware of it; that’s a whole academic department these days) and any criticism of somebody who isn’t a white male Christian is based on deep-seated racism (never mind that Mexican isn’t a race and Muslim isn’t a race; race just means Fashionable Minority these days, and there’s another whole six-pack of academic departments based on that delusion), and you get the BREAKING NEWS stories from people who are convinced that the most recent outrage by Trump or somebody plausibly (or even implausibly) connected to Trump is the Holy Last Straw That Broke the Camel’s Back.

The problem is that it never is. It really never is. In most cases it’s just Trump being Trump, and everybody in the Great Unwashed has finally cottoned to the fact that a lot of what Trump does is straight Republican stuff, and almost all of what Trump says is just Trump jerking the chains of the simpletons who inhabit the DemLegHump Media (which he does whenever he feels the urge to entertain himself).

The accuracy of the term The Last Strawman proceeds from the fact that in many of these cases the underlying supposed offense by Trump (or one of his people) is just imaginary on the part of the poor True Believer reporting (or commenting on) the incident.

Consider the notorious Access Hollywood tape that is the cornerstone of the widespread leftist belief that Trump Hates Women and Trump Is a Sexual Harasser. Yes, he did say ‘Grab ’em by the pussy!’ But if you actually watch the tape, he said that in the course of a conversation about how women will put up with some amazing shit from powerful men; this wasn’t a recommendation on his part, but more in the nature of a complaint. Nevertheless, everyone on the Left is convinced that this is Actual Evidence of Sexual Harassment on the part of Trump, and that he ought to be sent to the Gulag in the same train as Harvey Weinstein. But it’s totally bogus; a classic Straw Man.

A similar reflex operates with respect to Muslim terrorism. If somebody points out an incident where a Muslim extremist blows people up or shoots people down because they think their religion requires it (the famous ‘Allahu Akbar!’ shout is key), then a proglodyte will immediately go ape: ‘OMG! You think all Muslims are terrorists! You’re an Islamophobe! Unclean! Unclean!’. Well, no. The fact that Muslim extremists blow people up or shoot people down is just a fact, available to everyone through a simple internet search. I do a weekly post, Islamocopia Friday, that collects the numerous news items every week that document this very thing. Does this reflect a problem with Islam and mass murder? I think it’s pretty obvious that it does, and that’s independent of how one feels about Islam. But the proglodyte search for Heretics and Sinners doesn’t admit of nuance — anything that isn’t a bare recitation of The Party Line is beyond the pale and a sign of deep and ineradicable corruption.

So there it is. Look for it on a TV channel or in a newspaper near you.
