The unidentified 20-year-old woman got an abortion early on in her pregnancy, according to a court statement, but the abortionist failed to kill the fetus and now she is the mother of a little boy. This caused the woman to suffer “immense psychological trauma,” and she is demanding compensation from both the government and her doctor, who she says failed to realize she was still pregnant.
The woman underwent a surgical abortion one month into her pregnancy, which typically involves the abortionist suctioning or vacuuming the fetus out of the womb. It’s unclear from the report how the baby survived the procedure, but the woman apparently went back to her doctor thinking she might still be pregnant and reported a tender feeling and prickly sensation in her belly.
The doctor reportedly dismissed her concerns and did not perform an ultrasound to see if she was still pregnant. But a blood test later showed unusually high levels of hormones were still present, and a follow up ultrasound confirmed she was 20 weeks pregnant.
Obvious medical malpractice.
However, since she could have had another (attempted) abortion and didn’t, any competent defense attorney will argue that she could have mitigated her loss and didn’t, therefore reducing the liability of the abortionist.
They teach you that sort of thing in law school.

This extended whine by Nick Gillespie merely retreads the common delusion is that ‘appeal’ is like the weather, it just happens and those to whom it happens need to flounder around and find some sacrifice to the gods of Political Correctness that will get them on the Right Side of History.
It wasn’t always this way, of course, and looking at how Republicans went from being the default party of black voters after the Civil War to being a pariah among them is a way of understanding one highly probable future for the GOP as a minor party that represents a smaller and smaller bloc of voters who identify as “white” and “American” in strictly nativist terms.
Basically, the Republicans got out-bid. LBJ started the process with his remark, when signing the Civil Right Act, ‘Those niggers will vote for us for a hundred years.’ Northern Democrats essentially threw the Southern wing of their party overboard by realizing that they could purchase black politicians through corruption (always a Democrat specialty; look at the various city ‘machines’), and those corrupt black politicians would deliver the black vote through grievance-mongering (look at Jesse Jackson and Al Sharpton) and government benefit payoffs. Even today, the ‘appeal’ that Democrats have for black people is ‘Obama money’ from ‘his stash’, which is YOUR wallet.
An added bonus, probably not planned, was the destruction of the black culture through government welfare dependency. Destroy their families through ‘benefits’, destroy their communities through ‘housing projects’, destroy their schools through ‘identity politics’, and they have nowhere to turn except the government — and the Democrats, the party of government.
Black culture having been destroyed and made dependent on government, they are now turning to white underclass culture. Unlimited immigration of underclass Hispanics is forcing working-class whites into a poverty trap, from which the only salvation is — you guessed it — government benefits.
Blacks learned that if you don’t have any prospect of an honest job, drugs and crime are your only options. Now, underclass whites are learning the same lesson. Eventually you hit a tipping point where the only thing that underclass whites can aspire to is Eminem, who prospers by pretending to be black and beating real black people at their own ‘gangsta’ culture. We even see undoubtedly white people ‘identifying’ as black because they want to get in on the victim gravy train.

Nassim Nicholas Taleb points out why modern life sucks.
T he best example I know that gives insights into the functioning of a complex system is with the following situation. It suffices for an intransigent minority –a certain type of intransigent minorities –to reach a minutely small level, say three or four percent of the total population, for the entire population to have to submit to their preferences. Further, an optical illusion comes with the dominance of the minority: a naive observer would be under the impression that the choices and preferences are those of the majority. If it seems absurd, it is because our scientific intuitions aren’t calibrated for that (fughedabout scientific and academic intuitions and snap judgments; they don’t work and your standard intellectualization fails with complex systems, though not your grandmothers’ wisdom).

YoutubeIn the wake of the publication of a major interview with Juanita Broaddrick, a lot of left-leaning writers are soberly re-examining her decades’ old rape accusation against Bill Clinton—which seems to grow less plausible (or perhaps less important) in their eyes, the more it threatens Hillary Clinton’s presidential bid.
“While I (sort of? am leaning toward?) believe Juanita Broaddrick, her characterization of Hillary Clinton sounds irrational, maybe induced from PTSD,” writes Wonkette’s Rebecca Schoenkopf. Schoenkopf deserves credit for admitting a startling truth: her tribe is generally much less likely than this to agonize over accepting the victim’s narrative. “Why did Juanita Broaddrick change her story? ask people who otherwise would automatically answer ‘rape survivors do that sometimes,'” notes Schoenkopf.

Jim Goad doesn’t see any difference.
Over the weekend in Milwaukee, a black cop shot and killed an armed black man. In response, throngs of howling blacks rioted, looted, committed arson, and randomly attacked whites.
If that makes no sense to you, that’s because you’re not an idiot.
Justice is justice. Shenever you see a qualifier in front of it (‘social justice’, ‘economic justice’, ‘environmental justice’, etc.) it means that the term ‘justice’ is being hijacked by proponents of a political agenda who are hoping nobody will notice. Far too often, they’re right.
None of the Milwaukee rioters was victimized by the shooting. According to reports, the victim had a long criminal history and was turning around to point an illegally acquired gun at the black cop when he was shot dead in his tracks.
Excuse me for having oodles of grey matter and almost no melanin, but I fail to see the injustice here. Was the cop expected to simply allow himself to be murdered in the service of some dimwitted mob’s reptilian notions of “justice”? I’m not a mind reader, but I suspect his family would have considered that to be very unjust.

Tens of thousands of people across Venezuela are working in illegal mines tucked away in the nation’s jungles to provide subsistence for themselves and their families. So many have lost their jobs, with an unemployment rate reaching 8 percent this year, that mines are the only option for employment. In addition to payment, workers are contracting malaria that has long been dormant in these mines. After picking up the virus in the mines, workers return to their homes in the cities where the disease is spreading at an alarming rate.

“These residential spaces give support to members of our community with social identities that have been historically marginalized in this country,” the Hampshire website says. The website notes that the idea behind the system of rank segregation is to be “socially just” and “inclusive.”

The Claremont Independent reports Pitzer College student Kare Urena asked in the post that only people of color apply to live in her off-campus residence, adding that she didn’t “want to live with any white folks.”
A lot of that going around these days. Since the residence was off-campus, surely she has the right to live with people with whom she feels comfortable?
Pitzer President Melvin Oliver, who earlier this year became the first African American to lead a Claremont undergrad campus, calls the post “inconsistent with our mission and values.” He says the college wants to engage “complex intercultural issues, not to isolate individuals on the basis of any protected status.”
Look at his picture and find the ‘African-American’ — his skin is no darker than that of my family. But I suppose that these days ‘identifying as black’ is sufficient for affirmative-action purposes.
The Washington Post reports a roommate was found and the post has been removed, but Urena and another roommate are defending it. They say living with people of color “can be necessary.”
Of course, if a white student had requested a white roommate, he would have been lynched in the public square, and the Washington Post would have howled at the front of the mob.

At its annual meeting last month, the National Association for the Advancement of Colored People came out against new privately-managed charter schools—even though said schools are one of the best tools for providing poor black kids with quality education.
My, what a surprise! Aren’t you surprised? I’m sure surprised. The NAACP has been a wholly-owned subsidiary of the Democrat Party (which is a wholly-owned subsidiary of labor unions, especially government-employee labor unions, like teacher unions) since about 1970.
“Charter schools have contributed to the increased segregation rather than diverse integration of our public school system,” asserts the resolution, which was approved at the NAACP meeting. “Weak oversight of charter schools puts students and communities at risk of harm, public funds at risk of being wasted, and further erodes local control of public education.”
Hey, if Hillary can get away with her whoppers, let’s tell them another one.
It’s especially disappointing for the NAACP to go after charters, since they do so much good for struggling students of color. Some education reformers of color are furious.

A few days ago we had a commenter here who claimed to speak for all Europeans. We’ll leave aside for a moment his/her vaunting hubris, since you know, speaking for everyone from Russia to Portugal is a bit of a stretch.
Which doesn’t mean that millions feel any less empowered to do that.
That “reality” (No real realities were harmed in the making of this reality. Void or restricted according to local laws.) goes something like this: Obama is a moderate right winger, as is Hillary Clinton. Donald Trump is an extreme right winger.
For us Americans this feels somewhat like having the world suddenly shifted sideways 95 degrees. We go something like “Excuse me, but what part of bringing 1/3 of the economy under government control sounds like ‘right wing’ to you? And since when is someone who says ‘at some point you’ve made enough money?’ right wing? Are you out of your ever-loving mind, tovarish?” And as for Hilary and Trump “What in hell do you mean someone who wants single payer and thinks they can rule by executive order is right wing?”
…
Most people were not really aware of it, kind of like most people here aren’t aware of how far Marx’s crazy cakes ideas have penetrated academia, the press and entertainment. This is because if you take Marx’s ideas out and look at them objectively, after you take a bottle or so of ibuprofen, and wash it down with vodka, you’re still going “OMG, that’s insane.” But because those ideas were ported into teaching and reporting and the arts, with no explanation, no grounded, and applied to highly situational occasions, you never notice. Cheaper and cleaner nuclear plants could finally become reality—but not in the United States, where the technology was invented more than 50 years ago.
…
But even though molten-salt designs have energized inventive young technologists, getting a novel nuclear power technology licensed and built in the U.S. remains a daunting prospect. Simply applying for a license from the Nuclear Regulatory Commission can take years and cost hundreds of millions of dollars, which is why some of these startups may never get off the ground. What’s more, even $2 billion would be a lot of money for investors and utilities to spend on an unproven technology with questionable financial advantages. Which is why the program closest to producing a working reactor is in the People’s Republic of China.

Jim Goad understands the dialectic.
The transnational corporate and media elites who seek to smash borders and force 7.4 billion fundamentally incompatible human cattle together into a single inescapable One World Ranch claim that their motive is a lofty one—they seek to end perpetual conflict between nations.
That’s nice, but anyone with two unmedicated brain cells to rub together realizes that the end result of this daffy rainbow scheme would be perpetual conflict within what were formerly nations. It’s all unfolding with alarming speed before your lyin’ eyes at this very moment.
The leftist global elites—and there is no other kind of global elite—use the peasants like inanimate chess pieces in order to work out their own sick and warped guilt complexes. They live in all-white neighborhoods while smearing as “racists” the poor whites who have no choice but to live alongside a black underclass that is openly encouraged to resent them. They chatter and chirp about gun control while surrounding themselves with armed bodyguards. And they push a world-without-borders scheme while making sure they’re safely ensconced behind high walls and electronic gates.

Baffled, the experts searched for an answer. And they found one: the people went mad. They became mad from their anger at globalization. Globalization promised them riches, instead it made some of them unemployed. Or they became mad because of fear—fear from immigration and foreign people. Whatever the reason they went mad, the experts are sure of one thing: the fault is not with them. They gave sound advice. Their arguments were relevant. The fault is with the populace, not the leaders.

f you’re concerned about climate change, it would be perverse to fight a technology that can supply copious quantities of no-carbon energy 24 hours a day—right? Well, when it comes to nuclear power, lots of leading environmental activists are indulging in just such perversion. For orthodox greens, the only untainted electrons are those jiggled free by sunlight or stirred by wind.
One battle in this intra-green war just played out in New York State this week. The good news is that the eco-modernist supporters of nuclear power were strong enough to win. The bad news is that the plan they were fighting for will lead to more government meddling in energy markets.
When ‘progressives’ turn everything into a political question, government is invariably involved.
What happened? Unable to compete with heavily subsidized wind and solar power or electricity generated using cheap natural gas, the operators of four upstate New York nuclear reactors were planning to shut them down. Closing the plants would be a significant setback for Gov. Andrew Cuomo’s ambitious plan to reduce the state’s carbon dioxide emissions from the electric power sector. Currently the state gets 32 percent of its electricity from nuclear power, 19 percent from hydropower, 3 percent from wind, and 0.1 percent from solar. Burning natural gas currently generates about 41 percent of the state’s electricity with the remainder from coal and oil.
In order to forestall these nuclear shut-downs, state regulators decided this week to subsidize nuclear power plants at a rate of $500 million per year. The deal was announced by the state’s Public Service Commission when it adopted a plan to mandate that 50 percent of the state’s electricity be produced using renewable energy by 2030. Under the new Clean Energy Standards, each nuclear plant will be allocated zero emissions credits, which utilities must purchase when buying power from them. It is estimated that the credits will sell for about $17.48 per megawatt-hour of electricity. That money will go to the bottom lines of the plant’s owners, Entergy and Exelon. Now everybody’s a subsidized rent-seeker.
Welcome to the Obamanation.

The biggest problem facing the Rio Games may not be the filthy venues for aquatic events, or even security concerns in one of the world’s highest crime cities, but basic public health. The fears of transmission of Zika virus may be overblown, given that it’s the winter in Brazil and mosquito populations will be lower, but travelers run a real risk of contracting food-borne illnesses and influenza, according to the European Center for Disease Prevention and Control.

It is now possible to see how the progressive agenda thwarts the engine for growth in ways that private ingenuity finds it difficult to overcome. The initial observation is that virtually every progressive reform undermines free markets and tends to establish monopolies in labor, agriculture, and other industries. These rules frustrate the free entry into new markets. It is therefore inexcusable that the first impulse of the determined progressive is to impose restraints on voluntary exchange. These new taxes and regulations are always described benevolently as restrictions on the bad parties—on landlords, on employers, on insurers, on health care providers. But in practice they always operate as devastating constraint on both sides of the market. The labor law regime of collective bargaining that “protects” some employees also snuffs out opportunities for their nonunion competitors. Yet the Obama administration continues to place new obstacles that block access to marginal and teenage workers. It has sought to force franchisors like McDonald’s to be subject to liability for the alleged unfair labor practices of their franchisees; its Department of Labor works incessantly to subject ever larger segments of the economy, including the gig economy, to more serious regulations. These added regulations drive down employment opportunities and net wages, which keeps the next generation out of the middle class. When government raises the price of labor relative to capital, firms will be able to diversify in ways that workers cannot. Hence the greatest blows are landed on the intended beneficiaries of this misguided legislation.

The Black Lives Matter movement emerged as a force just about a year ago, following the killing of Ferguson, Missouri thug Michael Brown by a white police officer who was defending himself. The movement was predicated on a lie, namely that Brown was murdered without justification after he declared “hands up don’t shoot.” The Obama Justice Department would demonstrate the falsity of this claim.
The larger lie behind the Black Lives Matter movement is that American police officers are “executing” Black men. The evidence does not support this slander. Indeed, the evidence apparently doesn’t even support the more plausible claim that police officers, as a result of overreaction to perceived threats, are killing more Blacks than a completely race-neutral response would cause them to.
But the biggest lie of all is that the Black Lives Matter movement is a reaction to the loss of Black lives at the hands of the police. This was pretty evident from the outset. As a longtime observer of, and one time participant in, left-wing protests, the unrest in Ferguson seemed to me to have all the markings of generalized left-wing agitation opportunistically grafting on to the understandable protest over an unfortunate event.

As a condition of her suspension, Sethi was required to attend three days of sensitivity training. Sethi disagreed, but complied. Compliance was not enough, however, since it was clear that she still held her personal views. Black students at the University of Houston no longer felt that she was suited to represent them, and made this view known. Shane Smith, student body president (who is white) went on record with the Washington Post to articulate the students’ displeasure: “Her post and subsequent actions were very divisive,” he said. “It caused some in our student body to be upset with her. They lost their faith in her ability to represent them because they felt she did not understand or respect the struggle in their lives.”
