At issue was the case of a woman who suffered burn injuries after a hoverboard she purchased on Amazon in 2015 via a third party merchant caught on fire. Amazon argued that it was merely the platform connecting customers with sellers, but the appeals court found there was a “direct link in the vertical chain of distribution under California’s strict liability doctrine.”
California’s strict liability doctrine was the hook upon which my Torts professor in law school used to hang his You Can’t Make This Shit Up stories on Friday when nobody wanted to do any work.
If necessary, Amazon can just refuse to sell products in California. Let’s see how long California can hold out.

Justice Department nominee Kristen Clarke said while under oath she didn’t work with an anti-Semitic poet, though she was listed as an assistant editor for the same scholastic journal as the poet for several years.
Clarke said she never worked with poet and political activist Amiri Baraka despite being named an assistant editor for a scholastic journal that listed Baraka as a contributing editor in 1999 and 2000, according to the journal’s archives, first reported by The Washington Free Beacon. Baraka was known as a black nationalist and Marxist and was criticized for anti-Semitic lines in his poem “Somebody Blew Up America” after the Sept. 11 terror attacks, The New York Times reported in his 2014 obituary.

A major Biden nominee admitted to lawmakers on Thursday that she urged the president to take the unprecedented step of firing the nation’s top federal labor prosecutor, creating the vacancy that she now hopes to fill.
Jennifer Abruzzo, nominee for general counsel of the National Labor Relations Board (NLRB), told senators she was part of a team that recommended general counsel Peter Robb be removed before his term was set to end.
Of course except us geezers remember the Travelgate scandal of the Clinton years.

Last week, the Senate confirmed Vanita Gupta as Associate Attorney General, the number three position at the Department of Justice. Every Republican Senator except Lisa Murkowski, the Arlen Specter of the Klondike, voted against confirming Gupta.
Had Gupta’s nomination been rejected, the post would very likely have been filled by someone equally radical. However, that nominee probably would have been less vicious and less dishonest than Gupta. That’s the downside of her confirmation.

The draft rule primarily adds and alters definitions that are used to implement federal firearms laws. The new definitions make it possible for firearms to have more than one “frame or receiver.” A conclusion that is both at odds with the controlling federal statute and could disrupt the entire industry. It also creates an entirely new marking requirement for certain Federal Firearm Licensees that has no basis in federal statutes.
In effect, the rule would mean that many manufacturers would need to get pre-approval from ATF for new firearm designs. To put it another way, the draft takes 107 pages to say “we’ll know it when we see it.”

Former secretary of state John Kerry snitched to Iran about Israel’s efforts to undermine the rogue regime’s interests in Syria, according to leaked audio that surfaced over the weekend.
Iranian foreign minister Mohammad Javad Zarif, one of Kerry’s closest friends on the world stage, revealed in the leaked audiotape his “astonishment” at Kerry’s willingness to rat out an important American ally. Iranian leaders have repeatedly called for the destruction of Israel.
Snitching, or the act of revealing sensitive information about a so-called friend to impress another friend or authority figure, is generally frowned upon, especially among Democrats. Former president Barack Obama, for example, held a reelection fundraiser in 2012 featuring a number of NBA players, including prominent anti-snitching advocate Carmelo Anthony.

As Philadelphia’s top law enforcement officer spent two weeks on a jaunt through Europe financed by a liberal dark money group, the city witnessed 3 murders, 30 rapes, 63 armed robberies, and 120 assaults with a firearm.
Philadelphia district attorney Larry Krasner traveled to Germany and Portugal in May 2019, a year in which his city experienced a 12-year high in homicides. Liberal dark money group Fair and Just Prosecution footed the bill for Krasner and other attendees to learn from the European countries how to ease up on crime.

Congress and the president have adopted many critically important policies in great haste during brief periods of perceived national emergency. During the first “hundred days” of the Franklin D. Roosevelt administration in the spring of 1933, for example, the government abandoned the gold standard, enacted a system of wide-ranging controls, taxes, and subsidies in agriculture, and set in motion a plan to cartelize the nation’s manufacturing industries. In 2001, the USA PATRIOT Act was enacted in a rush even though no member of Congress had read it in its entirety. Since September 2008, the government and the Federal Reserve System have implemented a rapid-fire series of bailouts, loans, “stimulus” spending programs and partial or complete takeover of big banks and other large firms, acting at each step in great haste.
Any government policymaking on an important matter entails serious risks, but crisis policymaking stands apart from the more deliberate process in which new legislation is usually enacted or new regulatory measures are usually put into effect. Because formal institutional changes—however hastily they might have been made—have a strong tendency to become entrenched, remaining in effect for many years and sometimes for many decades, crisis policymaking has played an important part in generating long-term growth of government through a ratchet effect in which “temporary” emergency measures have expanded the government’s size, scope, or power.

Some books are dull because of their subject matter, and others are dull despite it. Senator Amy Klobuchar’s new opus, Antitrust: Taking on Monopoly Power from the Gilded Age to the Digital Age, manages to be even duller than its already dull subject. Though the last few pages detail Klobuchar’s goals as head of the Senate antitrust subcommittee and may therefore be useful for some readers, they’re packaged in 500 pages of incoherent fluff.
Of course, antitrust law is a warren of dull economic jargon, and even the flashiest author would be hard-pressed to jazz it up. Early on, the Minnesota Democrat announces her commitment to making it accessible to a lay audience: In Antitrust, this approach means we get a long discursion on her maternal grandparents.

The National Labor Relations Board overruled hundreds of Delaware poultry workers who had voted to reject union leadership. The agency said in a 3-1 ruling released Wednesday that a provision prohibiting workers from leaving a union for a set time period after a contract is signed allowed the board to ignore the workers’ March 2020 vote. The decision reversed a regional NLRB director who had initially ruled in the workers’ favor.

A mistrial occurs when 1) a jury is unable to reach a verdict and there must be a new trial with a new jury; 2) there is a serious procedural error or misconduct that would result in an unfair trial, and the judge adjourns the case without a decision on the merits and awards a new trial. See, e.g. Williamson v. United States, 512 U.S. 594 (1994).
In this case, serious error included a failure to sequester jury, leaving the jurors open to influence and intimidation, including, apparently, mob agitation by a sitting federal Congresswoman.
Noteworthy is that jury deliberation covered three days of evidence in a day, without asking the judge for instructions. Unlikely that any adequate deliberation took place is such a hasty time frame.

At the heart of the bizarre Twin Cities hellworld is Minnesota Governor Tim “tear down this” Walz. Today Tim is tearful. He called a press conference this afternoon to display his emotions and offer his characteristic deference to the mob throwing its weight around in the Twin Cities.
Walz mouths the obligatory platitudes about “systemic racism.” He asserts that Daunte Wright died “for a simple traffic violation.” He even calls this a “simple truth,” even though it is a blatant lie. He yammers on at painful length in his characteristic Joe Isuzu style demanding that citizens defer to the demands of the mob.

Robin Argenti cannot yet envision a future in which she doesn’t wear a mask. “We don’t know if it is going to ever be over,” the 57-year-old resident of upstate New York said of the pandemic. She’s in poor health, and concerned that with the emergence of new variants and the “millions of people who refuse to get vaccinated,” the country will never actually overcome the coronavirus. “I will be masked up for many, many years,” she said. “There are too many unknowns.”
As more and more Americans get vaccinated, the end of the pandemic feels palpable. Most people probably cannot wait to cut out the social distancing and take their masks off. I can’t wait for the day when I can walk down the street and look at a sea of strangers’ naked faces. But there are some people like Argenti who say they plan to make mask-wearing a part of daily life, even after the authorities give the thumbs-up to bare your entire face.

Nothing so surely signals the essential emptiness of Joe Biden than his rapid flip-flop Friday on raising the cap on the number of asylum seekers the United States will accept. At first the Biden Administration announced that they would not lift the relatively low cap that Trump had adopted, but following “outcry” from “Progressives,” Biden did a pirouette worthy of Bolshie ballerina and said he’d now lift the cap. One reason Biden had held the line, however briefly, on the asylum cap is that he’s polling terribly on immigration. But all it took was a gust of hot wind from “Progressives” to make him retreat.
